Overview and acceptance
NS Toolkit is operated by Nerdz Gaming Inc. (“Nerdz Gaming,” “we,” “us,” or “our”). These Terms of Service apply to nerdzgaming.com, shop.nerdzgaming.com, nerdzsearch.com, and the tools, user accounts, collection and deck services, event finder, store-credit features, and shopping services available through them (collectively, the “Service”).
By accessing or using the Service, creating an account, or making a purchase, you agree to these terms and our applicable policies. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal information, and our Returns & Refunds Policy applies to eligible purchases made directly from us.
Eligibility and accounts
- You represent that you are at least the age of majority where you live, or that a parent or legal guardian has authorized your use of the Service.
- You must provide accurate, current information and keep your account details up to date. You are responsible for safeguarding your sign-in credentials and for activity under your account.
- Tell us promptly if you suspect unauthorized account access. We may restrict, suspend, or close an account when reasonably necessary to address fraud, abuse, security risks, legal obligations, or violations of these terms.
- We may refuse service or cancel an order where permitted by law. Any affected payment will be handled in accordance with applicable law and our posted policies.
Shop services, orders, and checkout
Our online store and secure checkout are hosted by Shopify and may use shop.nerdzgaming.com. Placing an order is an offer to purchase. An order is not accepted until payment is authorized and we confirm acceptance or fulfilment. We may limit quantities or cancel an order because of stock availability, pricing errors, suspected fraud, shipping restrictions, or other lawful reasons.
Product descriptions, availability, card values, inventory counts, and prices may change without notice. We try to keep them accurate, but may correct errors and cancel affected orders. Taxes, delivery charges, currency conversion, and other applicable costs are shown or calculated during checkout where required.
Cancellations, returns, exchanges, and refunds for direct purchases are governed by our Returns & Refunds Policy. Nothing in these terms limits a mandatory consumer right that cannot legally be excluded.
Nerd Dollars
Nerd Dollars are digital store credit linked to an eligible customer profile. They have no cash value, are non-transferable, and cannot be redeemed for cash except where required by law. They may be applied only to eligible purchases through our checkout and remain subject to any limits shown when issued.
We may audit, correct, suspend, or revoke Nerd Dollars associated with a system error, duplicate credit, fraud, refund, chargeback, or violation of these terms. We will not reduce a valid balance arbitrarily, and applicable legal rights remain unaffected.
Third-party services and external purchases
NS Toolkit uses or displays data from third parties, which may include Scryfall, TCGplayer, Mana Pool, CardTrader, Shopify, SortSwift, TopDeck.gg, and other marketplaces or service providers. Their card data, rules text, images, event listings, market prices, and inventory information may be delayed, incomplete, or inaccurate. Displayed prices are estimates until confirmed by the seller at checkout.
A link to an outside marketplace, retailer, event organizer, or other service does not make us the seller or organizer. Purchases made on an external website are agreements between you and that third party. Nerdz Gaming does not process or control those orders, payments, fulfilment, shipping, cancellations, returns, refunds, warranties, or disputes. Contact the business named on your receipt for help.
External services are governed by their own terms and privacy policies. We are not responsible for their availability, rate limits, outages, content, or policy changes. References to third-party names do not imply endorsement or affiliation.
Platform rights and user content
The Service’s original software, design, interface, text, and tool logic belong to Nerdz Gaming or its licensors and are protected by applicable intellectual property laws. You may use the Service for personal, lawful purposes, but may not copy, sell, sublicense, reverse engineer, or commercially exploit it without permission except where the law expressly allows.
Card names, art, rules text, game symbols, and third-party marks belong to their respective owners. Their display does not transfer ownership to Nerdz Gaming or to you.
You retain ownership of decklists, collection information, community messages, feedback, and other content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, process, and distribute that content only as needed to operate, secure, promote, and improve the Service. You confirm that you have the rights needed to submit it. You may remove content where the Service provides that option, subject to reasonable backups and legal retention requirements.
We may moderate or remove content that violates these terms, infringes rights, creates safety or legal risks, or disrupts the community. We are not required to monitor every submission.
Prohibited uses
You may not use the Service to:
- Break the law, violate another person’s rights, or facilitate wrongdoing;
- Harass, threaten, defame, impersonate, discriminate against, or harm another user or staff member;
- Upload malware, destructive code, spam, or content you do not have the right to share;
- Bypass security or access controls, probe for vulnerabilities, exploit errors, or access another person’s account or private data;
- Use bots, scrapers, or automated harvesting in a way that burdens the Service, evades limits, or violates a provider’s terms; or
- Manipulate store credit, pricing, inventory, referrals, or marketplace links.
Service availability
We may update, suspend, or discontinue features, integrations, or the Service. We do not promise uninterrupted or error-free access, permanent storage of user data, or continuing support for any particular third-party integration. Keep independent copies of decklists, collection records, or other information that is important to you.
Disclaimer of warranties
To the fullest extent permitted by law, the Service, its tools, search results, pricing, inventory, event listings, and community content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. This disclaimer does not exclude warranties or rights that applicable law does not allow us to exclude.
Limitation of liability
To the fullest extent permitted by law, Nerdz Gaming and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from the Service or an external transaction.
Where liability cannot be excluded, our aggregate liability relating to the Service will not exceed the greater of the amount you paid directly to Nerdz Gaming for the matter giving rise to the claim during the previous 12 months or CAD $100. These limits do not apply to liability that cannot legally be limited, including any mandatory consumer protections.
Governing law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights in your jurisdiction, disputes will be brought before the courts of Ontario, Canada. Before starting a formal claim, please contact us so we can try to resolve the issue directly.
Changes and general terms
We may update these terms by posting a revised version here and changing the “Last updated” date. Material changes will apply prospectively. Continued use of the Service after revised terms take effect means you accept them, where permitted by law.
If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the rest will remain effective. A delay in enforcing a term is not a waiver. These terms and the policies linked from them form the entire agreement between you and Nerdz Gaming concerning the Service, except for any additional terms presented for a specific product or feature.
